Training and medical disclaimer

HDR Apex provides training organization and decision support. It is not medical care, emergency monitoring, or a substitute for a qualified coach or healthcare professional. Recommendations may be incomplete, delayed, inaccurate, or inappropriate for a particular athlete. You decide whether and how to perform every workout and agree to stop and obtain appropriate assistance when symptoms, injury, conditions, or circumstances warrant it.

Assumption of risk

You understand that endurance training and outdoor activities—including running, cycling, swimming, paddling, hiking, navigation, racing, and multisport events—are inherently hazardous. Risks include falls, collisions, vehicle traffic, drowning, heat or cold illness, exposure, dehydration, wildlife, difficult terrain, getting lost, equipment failure, overtraining, delayed rescue, serious injury, permanent disability, and death. You knowingly and voluntarily assume these risks, including risks arising from reliance on app recommendations or connected-device data.

Release and hold harmless

To the fullest extent permitted by applicable law, you release and agree to hold harmless HDR Performance, LLC, HDR Apex, and their owners, officers, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, losses, or expenses arising from your training, event participation, route selection, equipment use, health decisions, or use of the service, including claims based on ordinary negligence. This provision does not waive liability that cannot legally be waived.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold the released parties harmless from third-party claims arising from your misuse of the service, violation of these terms, unauthorized coaching or publication of workouts for another person, or violation of another person’s rights.

AI and connected services

AI-generated workouts are drafts until approved by the athlete or authorized coach. Garmin, TrainingPeaks, GPS, wearable sensors, weather sources, and other services may provide incomplete, delayed, or inaccurate information. HDR Apex does not guarantee device synchronization, route safety, rescue availability, performance results, or freedom from injury.

Legal review required

Final commercial terms—including governing law, venue, dispute resolution, liability caps, age requirements, and contact information—must be reviewed by counsel before public launch.
